Well, nailing a mafia member , especially a boss, is different than the average criminal. With the mafia they want to nail them under the RICO act. All that does really is remove any chance of defense and puts them in prison forever. With theft or murder charges they have a chance to walk, plea bargain and eventually leave prison in most cases, but uner RICO, forget about it...
On the other hand Al Capone was way before RICO, but back then the government was smaller, law enforcement not what it is now and I'm sure he got away with A LOT of shit just by paying cops off.
